The SSA reviews the SSDI and decides whether or not to approve, deny, remand, or request additional information. The SSA then sends a memo indicating whether or not the data-related agreement has been approved, deferred or remanded to the MDH Unit. If the agreement is approved by the MDH Unit, execution may be started.
If an applicant is denied, the SSA sends a second warning. Within sixty-five days, the denied applicant can request a hearing before an Administrative Law Judge. Similar to hearings on disability issues, this hearing can be requested. It can be held in person, over the phone, or via videoconference. The hearing may include witnesses from the applicant's or his/her representative who can testify about the issues or the circumstances of the denial. An ALJ may arrange for expert witness testimony to support the case. The ALJ may notify the applicant by writing if they lose. The hearing could take many months.

A disability review could take up to seven years. It could be denied, approved or remanded if the applicant needs additional information. If an individual is able or able, the SSA may initiate a disability evaluation.

A Data-Related Agreement is a legal document that requires approval from the SDI Team prior to execution. These agreements must submitted via CognitoForms. The SDI Team will have 30 days to review the Data-Related Agreement. They can also ask for additional information, such a SOC 2 Type II or security controls. They may also request additional information, such as questions related to data migration.
Once a Data-Related Agreement is submitted, the SDI Team will review the documentation and proposed contracts. The Agreement is subjected the same privacy and security policies that other forms of documentation submitted via Cognito Forms.
